Anniversary Day - Labour Dept
Chamber Southland brought the issue into the public arena with
the announcing of March 25th as Southland Anniversary Day.
(see full information
here...)
Correspondence and conversations were held with many stakeholders
and media statements were made.
Among these was an article instigated by John Pannett Southland’s
Dept of Labour Service Manager. View his Article
here.
In prior conversation with him it was clear that the Department’s
view is that the issue is to complex for them and that they would
take the least line of resistance and not take a stand on the
date.
As far as they are concerned the ‘status quo’ will exist and that
it is unlikely that the Department will take a case to court on the
basics of which day was taken.
As far as we are concerned Southland's Anniversary Day is March
25th
NB this is the decision of the
Department and not necessarily that of the courts.
We make reference to Nov 14:2007 (AirNZ vs NZ
Airline Pilots Assoc)
The Department of Labour’s decision may not hinder private claims
to the employment court by unions or individuals.
We strongly suggest you contact your HR or legal adviser for
assistance.
And include, after ‘good faith’ bargaining, into the employment
contract, a date agreeable by both parties.
