Returning of goods
Returning or exchanging of goods or
purchases
(posted 01/02/2008)
Contrary to popular belief, there is no legal requirement to
exchange or to refund items if the customer doesn’t like them or
they are the wrong size or colour.
(However you may choose to do so, or exchange the product, give
a credit note or gift voucher for your business)
If gifts
or items are faulty or damaged (but not by the customer) then you
are obliged to refund, replace, or repair them.
When you sell something, the law says it must be fit for the
intended normal purpose, with an acceptable finish and appearance.
It should also be free from minor defects, safe, and last a
reasonable time for that type of goods.
- If a purchase turns out to be faulty and the fault is minor,
the Consumer Guarantees Act gives the receiver of the goods rights
to remedy the situation. As the trader you can choose to replace or
refund the item, or have the item repaired.
- If the fault is serious the customer can also choose to have a
refund or replacement, or keep the goods but ask for compensation
to make up for the drop in value caused by the fault.
- A manufacturer’s warranty should apply to, even if the customer
didn't buy the goods themselves.
